I. Identifying Data

This warning and legal conditions (hereinafter, the '' Legal Warning '') normalizes the use of the services of the following Internet portals "www.ence.es", "www.compramosmadera.es" and "www.encepontevedra.com "(hereinafter, the" Portal "). It is recommended to read the following conditions carefully.

In order to comply with the duty of information in accordance with the provisions of Article 10 of Law 34/2002, of July 11, Services of the Information Society and Electronic Commerce, the following data is reflected below:

II. Users

Access and/or use of the ENCE Portal, attributes the condition of user, (hereinafter, the '' User '') that fully accepts, from the moment of access and/or use, the General Conditions of Use that are reflected here. 

III. Use of the Portal

ENCE Portal provides access to a multitude of information, programs or data (hereinafter, the "Services") on the Internet belonging to ENCE or to its licensors to which the User may have access.

The provision of the Services, by ENCE has free character for Users.

The User assumes the responsibility of using the Portal, which extends to the registration or completion of forms required to access certain services or content. In any case, the registration will be made in the manner expressly indicated in the service itself, the User being responsible for providing truthful and lawful information, and keeping the information provided at all times updated.

As a consequence of this registration, the User can be provided with a password for which he will be responsible, committing himself to make diligent and confidential use of it.

The User shall be solely responsible for the false and inaccurate statements made and the damages caused to ENCE or to third parties for the information you provide.

In addition, the User agrees to make an appropriate use of the Web and its Services, without violating the provisions of this Legal Warning, by prohibiting the following:

  1. Influence activities that are illicit, illegal or contrary to public order.
  2. Disseminate content or advertising of a racist, xenophobic, pornographic-illegal nature, advocating terrorism or attacking human rights.
  3. Causing damage to the physical and logical systems of ENCE, its suppliers or third parties, introducing or spreading computer viruses or any other physical or logical systems that are likely to cause the aforementioned damage.
  4. Try to access and, in that case, use the email accounts of other Users and modify or manipulate their messages.

ENCE reserves the right to withdraw all comments and contributions that violate respect for the dignity of the person, that are discriminatory, xenophobic, racist, pornographic, that attempt against youth or childhood, order or public safety or that, in their judgment, they will not be suitable for publication. In any case, ENCE will not be responsible for the opinions expressed by the Users through forums, chats, or other participation tools.

Regarding the contents (information, photographs, design, text, sound files and image files), it will be forbidden:

  1. Reproducing, copying, distributing, disseminating, transforming or modifying, and communicating them publicly unless authorized by the legitimate owner or legally permitted.
  2. Violate the rights of ENCE or of its legitimate owners over them.
  3. Use them for all types of commercial or advertising purposes, other than those allowed.
  4. Try to obtain the contents of the Portal by any means other than those that are made available to users as well as those usually used in the network.

IV. Personal Data Protection – Privacy Policy of ENCE

ENCE complies with current legislation in Spain and with the guidelines established in Regulation (EU) 2016/679 of the European Parliament and the Council, and ensures the correct use and treatment of personal data of the User.

ENCE may collect, in each form required for access to certain Services or content, personal data for storage and/or use, in relation to the User. Automatically, that data will be included in the databases which are the responsibility of ENCE (hereinafter, the ''Data Controller'') whose contact information is found in section I. of this Legal Warning.

The Data Controller ensures that the collected data is going to be processed and treated with the following purposes:

  1. Provision of the Wood purchase services
  2. Management of recruitment processes
  3. Questionnaires on forest management for groups of interest

The legitimate basis of treatment for all of the above purposes is the interested party consent. In addition, these data could be used for the profile elaboration.

The data obtained may be transferred to other companies in the group or to third parties that provide management services for these treatments.

In addition, your data will not be transferred to countries outside the European Union, except for reasons of provision of technical services, such as, that the servers of the systems or technological resources suppliers are allocated in those countries.

However, ENCE may transfer your data to third parties if such transfer is required by law, by a regulatory provision or by a court ruling, or if this disclosure is necessary to guarantee the protection and defense of your rights.

At any time, the User may exercise their rights of Access, Rectification, Cancellation or Erasure, Opposition, Automated Opposition, Portability and Limitation of the Treatment, following the procedure of the document "Instructions for the Exercise of Rights of the Interested Party", available on the page ENCE website.

V. Intellectual and Industrial Property

ENCE by itself or as an assignee, is the owner of all the intellectual and industrial property rights of its website, as well as the elements contained in it (for example, images, sound, audio, video, software or texts, trademarks or logos, color combinations, structure and design, selection of used materials, computer programs necessary for its operation, access and use, etc.), owned by ENCE or from its licensors.

All rights reserved. By virtue of what is established in articles 8 and 32.1, second paragraph, of the Law on Intellectual Property, the reproduction, distribution and public communication, including the method of making them available, of all or part of the contents of this website, for commercial purposes, in any medium and by any technical means, without the authorization of ENCE, is expressly prohibited. The User agrees to respect the Intellectual and Industrial Property rights owned by ENCE You can view the elements of the Portal and even print them, copy them and store them on your computer's hard drive or any other physical medium, provided that it is, solely and exclusively, for your personal and private use. The User must refrain from deleting, altering, evading or manipulating any protection device or security system that was installed on the pages of ENCE.

VI. Exclusion of guarantees and responsibility

Under no circumstances ENCE will guarantee or be responsible for damages of any kind that may arise, for example:

  1. Errors or omissions in the contents and/or services.
  2. Lack of availability and effective functioning of the Portal and/or Services and contents.
  3. The presence or transmission of viruses or malicious programs despite having configured all technological measures to prevent it.
  4. Forum user’s opinions and messages in the different areas of the Portal.
  5. Illicit, negligent, fraudulent use, contrary to these General Conditions, to the good faith, to the generally accepted uses or to the public order of the Portal, its Services or contents, by the users.

VII. Modifications

ENCE may, without prior notice, and whenever it deems appropriate, unilaterally modify the structure and design of the Portal as well as its conditions of access and / or use. In addition, ENCE could delete or add the contents and Services provided through it, as well as the way in which they appear presented or located in the Portal. 

 

VIII. Hyperlinks

The ENCE Portal may have links or hyperlinks to other Internet sites controlled and managed by third parties.

ENCE does not exercise any type of control, nor does it market or endorse the contents, services, information and statements available on its websites. Likewise, the inclusion of these external connections does not imply any type of association, merger or participation with the connected entities.

In no case, ENCE will assume any type of responsibility, not even indirectly or subsidiary, for the contents of a link belonging to a third party website, and/or for damages of any kind that may arise from access to same. Nor shall the technical availability, reliability, quality, accuracy, amplitude, veracity, validity and constitutionality of any material or information contained in any of those hyperlinks or other Internet sites be guaranteed. 

IX. Right of exclusion

ENCE reserves the right to deny or withdraw access to the Portal and/or the Services offered if need for prior notice, at its own request or from a third party, to those users who fail to comply with these General Conditions of use. 

X.  Generalities

ENCE will pursue the breach of these Conditions as well as any improper use of its Portal, exercising all civil and criminal actions that may correspond to it by law. 

XI. Modification of the present General Conditions

ENCE may modify the stipulated conditions at any time, being duly published as they are presented here. The validity of the aforementioned conditions will be in accordance with their exposure and will be in force until they are modified by others duly published. 

XII. Duration

The provision of the website service, as well as the services it offers, will have an indefinite duration. However, ENCE reserves the right to interrupt, suspend or terminate the provision of the Portal service or any of the services and/or contents that comprise it.
